      <title>Supporting Your Intellectual Property Investments: The 2026 SME Fund</title>

&lt;p&gt;&lt;span&gt;For the 2026 edition, the Fund offers several financial advantages that can significantly reduce the cost of securing trademarks, designs, and patents. Companies may benefit from subsidies of up to €700 per company for trademark and design filings, and up to €3,500 per company for patents—specifically €1,000 for national patent applications and €2,500 for European patent applications. These grants make it easier for SMEs to take a proactive approach to safeguarding their innovations.&lt;/span&gt;&lt;span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;In addition to these substantial subsidies, the program provides reimbursement of up to 75% of official filing fees. This high coverage rate enables smaller businesses to allocate resources more efficiently while ensuring their intangible assets are properly protected. Importantly, all SEs and SMEs established within the European Union are eligible to apply, broadening access to companies across all sectors.&lt;/span&gt;&lt;span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;To benefit from the SME Fund, companies must follow certain strategic requirements.       <title>SEP Patents – Regional court Munich states calculation formula for FRAND-license corridor</title>
      <description>&lt;p&gt;When a patent is declared essential to a technical standard (a "standard-essential patent" or SEP), the patent holder commits to licensing it on FRAND terms. FRAND does not denote a single fixed royalty rate but rather a corridor of acceptable conditions.&lt;/p&gt;
&lt;p&gt;In a very recent case (file No. 7 O 7655/25) in which the German partner firm of AIPEX, Prinz &amp;amp; Partner, was involved the Munich I Regional Court stated how the FRAND corridor shall be calculated where comparable licence agreements already exist.&lt;/p&gt;
&lt;p&gt;The court held that the highest permissible rate must not exceed three times the lowest, equivalent to a 50% deviation above or below a median value. Example: where the median rate is 5 % license fee rate, the FRAND corridor extends from 2.5 to 7.5 %.&lt;/p&gt;
&lt;p&gt;Where additional, less comparable licence agreements exist, these may indicate that the primary reference rate is a favourable outlier rather than a true median, thereby shifting the corridor upwards. Example: the primary comparable licence shows a rate of 5 % but further, less comparable agreements indicate a rate of 6 % for similar products. Thus, there are grounds to treat the rate of 5 as below the true median so that the median within a normalised corridor of 1 to 3 could shift from 2 to 1.8, leading to a FRAND corridor of 2.78 % (5% / 1.8) to 8.33 (5 % x 3 / 1.8).&lt;/p&gt;
&lt;p&gt;Where a directly comparable competitor licence exists, the upper limit is further capped at a 15% premium over that rate, reflecting the non-discrimination obligation. Justifiable grounds for differentiation within the corridor include the scope of the licence and the conduct of the parties, as a licensee who concludes an agreement promptly causes less administrative burden and thus may benefit from a lower license rate.&lt;/p&gt;</description>

&lt;p&gt;&lt;span&gt;The Dutch government recently announced plans to make major changes to the Dutch Patent Act (Rijksoctrooiwet). The goal is to strengthen investment certainty and improve the competitiveness of Dutch businesses.&lt;sup&gt; [1]&lt;/sup&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;Currently, patents in the Netherlands can be granted without a complete examination. This means that patent applications may not be checked for novelty or inventiveness before a patent is granted. The government believes this situation can create legal uncertainty and impact the reliability of patent protection for businesses and investors.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;Under the proposed reform, all patent applications would receive a thorough examination by Octrooicentrum Nederland before any patent is granted. This aims to ensure that only inventions that meet the necessary criteria get protection, which would improve the quality and credibility of Dutch patents.&lt;/span&gt;&lt;/p&gt;

      <title>UKIPO Official Fees to Rise from 1 April 2026</title>
      <description>&lt;p&gt;The UK Intellectual Property Office (UKIPO) has confirmed that official fees for patents, trade marks and designs will increase with effect from 1 April 2026.&lt;/p&gt;
&lt;p&gt;Current (lower) fees will continue to apply up to and including 31 March 2026, with the new (higher) fees applying from 1 April 2026 onwards. This represents the first major increase in many years, with average fee rises of around 25% across patents, trade marks and designs.&lt;/p&gt;
&lt;p&gt;Clients with planned filings, renewals or other fee-related actions may therefore wish to consider acting before 1 April 2026 to benefit from the current fee levels.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;strong&gt;What should you do now?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;If you have any planned UK patent, trade mark or design filings, or renewals due in 2026, it is worth reviewing these now. In many cases, applications can be filed and renewals can be paid before 1 April 2026 at the current UKIPO fee, even where the formal deadline falls later.&lt;/p&gt;
&lt;p&gt;Bringing action forward can therefore result in meaningful cost savings, particularly for larger portfolios. Owners of large portfolios of granted UK IP rights should consider the advice provided below on renewal fee (annuity) payments, since significant cost savings might be achieved by paying eligible renewal fees prior to 1 April. If you are unsure whether a particular action can be accelerated, or whether it is cost-effective to do so, we would be pleased to advise.&lt;/p&gt;

&lt;p&gt;UKIPO fees have been held at historic levels for many years - trade mark fees since 1998, design fees since 2016, and patent fees since 2018.&lt;/p&gt;
&lt;p&gt;The increases reflect inflation over that period (around a 32% rise since 2016) and the costs of maintaining and improving UKIPO services. Across patents, trade marks, registered designs and unregistered designs, fees will rise by around 25% on average.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Why This Matters&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The way the increase is implemented means that many costs can be avoided or reduced by acting earlier, particularly in relation to:&lt;/p&gt;
&lt;p&gt;· upcoming patent, trade mark or design renewals;&lt;/p&gt;
&lt;p&gt;· deferred design publications; and&lt;/p&gt;
&lt;p&gt;· planned oppositions or recordals.&lt;/p&gt;

&lt;p&gt;For clients with multiple rights, the cumulative savings can be significant. This is why the timing rules set out below are important.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;How the Fee Increase Will Apply in Practice&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Renewal cycles&lt;/p&gt;
&lt;p&gt;To remain in force:&lt;/p&gt;
&lt;p&gt;· patents are renewed annually;&lt;/p&gt;
&lt;p&gt;· registered designs every 5 years; and&lt;/p&gt;
&lt;p&gt;· trade marks every 10 years.&lt;/p&gt;

&lt;p&gt;Renewal fees may be paid in advance:&lt;/p&gt;
&lt;p&gt;· up to 3 months early for patents; and&lt;/p&gt;

&lt;p&gt;A 6-month late renewal period is also available, although this incurs a separate late renewal fee.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Which Fee Applies – Old or New?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Whether the current fee or the new increased fee applies depends on:&lt;/p&gt;
&lt;p&gt;1. the renewal due date, and&lt;/p&gt;
&lt;p&gt;2. the date the renewal fee is paid.&lt;/p&gt;

It is worth bearing in mind, however, that obtaining a patent is rarely an end in itself – it is often a key element of a broader business strategy, helping to build a competitive advantage and attracting the attention of potential investors.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Three pillars of patenting: novelty, inventive step, industrial application&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;For our invention to get its desired patent ‘ticket’, it must successfully meet three key conditions.&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;The first is the &lt;strong&gt;absolute novelty&lt;/strong&gt;. If only the idea manages to see the daylight - in the pages of a publication or from a conference podium – the chance for protection is lost irretrievably, and that is the end of the story.&lt;/li&gt;
&lt;li&gt;The next obstacle to overcome is the &lt;strong&gt;inventive step&lt;/strong&gt;, a truly revolutionary spark. It is not enough here to make a cosmetic improvement to what is already known – what is needed is a solution that would be a surprise and a breath of fresh air for the expert.&lt;/li&gt;
&lt;li&gt;Finally, there is &lt;strong&gt;the industrial application&lt;/strong&gt;. Even the most promising concept will not get the stamp of protection if it cannot be translated into real operations in a factory or when providing services. To get a patent, therefore, we need to prove that our brilliant idea will work not only in the theory, but also in the real life.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&lt;strong&gt;What does a patent application consist of?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;When filing a patent application, it is worth being aware that every detail in the documentation can determine its fate - sometimes all it takes is one inconspicuous sentence to open the door to the protection of an invention or... slam it shut.&lt;/p&gt;
&lt;p&gt;The heart of the application is &lt;strong&gt;the description of the invention – it must clearly yet comprehensively reflect the essence of the innovation, the principles of its operation and how it solves a specific technical problem.&lt;/strong&gt; It should be precise enough so that an expert in a particular field can easily reproduce the whole thing step by step.&lt;/p&gt;
&lt;p&gt;No less important are the patent claims, which set the boundaries of legal protection and define what exactly falls within the scope of the inventor's monopoly. Their drafting requires finesse – they should be broad enough to provide the widest possible protection, but at the same time precise and well-justified enough to avoid any legal gaps.&lt;/p&gt;
&lt;p&gt;In the field of technical and mechanical inventions, figures play an invaluable role – they, in graphical form, take over part of the explanation and allow one to intuitively catch the essence of the solution. The whole is crowned with an abstract – a short, essential description that goes into public databases and serves as a showpiece of the application, allowing one to quickly get an idea of its content.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The most common mistakes to avoid&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Although the whole mechanism for obtaining a patent is not overly complicated, it is not difficult to stumble here, which can result in the rejection of the application or an unpleasant prolongation of the proceedings. The first trap can be &lt;strong&gt;too superficial description of the invention&lt;/strong&gt; – if you do not explain exactly what the novelty is and how it can be reproduced, the patent office may consider that you have not met the requirement of sufficient disclosure. Another offense is &lt;strong&gt;to broadcast details too early&lt;/strong&gt;. Sometimes simply mentioning a concept during a public presentation or uploading it to a website is enough to violate the novelty condition and thus erode the chances of successful protection.&lt;/p&gt;
&lt;p&gt;We enter equally slippery ground when &lt;strong&gt;drafting patent claims – excessive narrowness may not be enough to defend an idea against the actions of competitors, while excessively broad phrases expose us to the attentions of patent examiners, who may demand a correction or even reject the application.&lt;/strong&gt; Existing concepts should also not be forgotten. &lt;strong&gt;Without first reviewing the available patent databases, we risk that our potential invention will turn out to conflict with what someone has already patented in the past.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;When the documents reach the patent office, a long and demanding expedition through the maze of procedures - both formal and substantive – begins. It is a journey in which every step is carefully scrutinized by experts tracking down similar solutions in the registers and assessing the application's compliance with strict requirements. Inevitably, there are questions and objections from the officials, which must be answered quickly and precisely. Sometimes this means fine-tuning the documentation, detailing the description or redrafting the patent claims.&lt;/p&gt;
&lt;p&gt;Any stumble, delay or oversight can prolong the entire process and, in the worst-case scenario, completely close the door to protecting the invention.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The importance of well-prepared claims&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Patent claims are the real backbone of a patent application - they determine its scope of protection and prejudge whether our innovation will be effectively protected.&lt;/strong&gt; If worded too narrowly, competitors will easily “leapfrog” protection with only subtle modifications. An overly broad formulation, on the other hand, usually leads straight into the arms of litigation and endlessly drawn-out negotiations with the patent office. To avoid falling into one of these traps, &lt;strong&gt;it is most important to accurately capture the essence of the invention - its most important, novel aspect&lt;/strong&gt;. In this process, &lt;strong&gt;a state of the art analysis, namely a thorough review of already existing patents and scientific publications, proves to be indispensable. &lt;/strong&gt;This makes it possible not only to make sure that our idea really brings something new, but also to precisely define such a scope of protection that will be both effective and viable to defend.&lt;/p&gt;

      <title>AI SYSTEM AS AN OPERATING ROOM ASSISTANT OR MAINTENANCE PREDICTOR</title>

&lt;p&gt;The use of artificial intelligence (AI) in industry is booming, especially in the software sector and medtech. It is often used for analysing large databases, but also for developing innovations and that creates new IP (intellectual property). However, this is only patentable if it does not consist solely of software. Bert Kneepkens from IP agency AOMB explains how you can protect AI against infringement with IP.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Shaped by his profession, patent agent Bert Kneepkens is a man of careful wording. In answer to the opening question ‘can AI be effectively protected against IP infringement?’ he immediately gets stuck on the word ‘effectively.’ ‘Because that’s a relative term that means something different for everyone. A better formulation of the question would be Can AI be protected, yes or no?’, he explains. But neither is it a question to which he can answer with a simple ‘yes’ or ‘no’. It depends on what exactly is meant by ‘AI’.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;PATENTABLE AS A PART&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;‘Everything,’ he begins his explanation, ‘is in principle patentable. But there are exceptions such as natural phenomena, abstract ideas, mathematical theories and discoveries that are not the result of human effort. E=MC2, for instance, is an expression of a physical phenomenon that, like the Pythagorean theorem, is excluded from patenting. And that also applies to software as such. Because that concerns text, either in the form of source code or as embedded code and is therefore subject to copyright.’&lt;/p&gt;
&lt;p&gt;The latter is relevant to the answer to the question asked. Because AI is software. Yet it can be patented, as long as it is not software as such. That requires a different approach. For instance, if the software is interpreted as part of a system that also includes hardware, it is possible. So AI and the algorithms it uses may be patentable as part of, for instance, a system with a camera to check products for the correct quality’, he defines.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;NEW AND INVENTIVE&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Whether this is actually the case depends on whether two other requirements are met: the invention must be ‘new’ and ‘inventive’. ‘A wheel obviously cannot be patented, that is not new. If you add a special configuration of spokes, it is new. However, it only becomes inventive if that configuration solves a problem in a non-obvious way. These requirements are no different for AI. If, as a bicycle manufacturer, you are able to discover manufacturing defects in your bicycles with a certain existing AI model, the application may be new. However, the question is whether it is inventive to use this existing model for this new application. When you use a spanner as a hammer, that is new. But is it inventive? Even then it depends on whether you solve a problem in a non-obvious way. If the spanner has been redesigned for this purpose, then that’s a good indicator of inventiveness.’&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;AI IS BOOMING&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;In his practice at the Eindhoven IP agency AOMB, Kneepkens has noted that demand for patents for AI systems has increased significantly over the past two years. A growth that is especially visible in the software market segment; interest from high-tech mechanical engineering has increased less strongly. ‘An understandable trend because both software and AI are in the digital domain. Although AI will certainly play a role in machines such as those from ASML, for instance, in production quality assurance software, new technologies such as quantum computing and photonics are of greater importance in the high-tech sector. But the application of AI in the biotech and medical sectors is really booming.’&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;WELL-INFORMED OR ASSISTANT&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;For instance, Kneepkens recently had an inventor at his desk who is developing an AI system to improve operations on brain tumours. ‘If someone is suspected of having a brain tumour and surgery is required, the skull must be removed. Biopsies are taken to determine which type of tumour it is and therefore how drastic the cut needs to be. However, its analysis takes a long time. And of course the skull cannot remain open for that long. Thanks to impressive AI, the surgeon can now determine during the operation which type of brain tumour the patient has, allowing him to more accurately determine what is tumour tissue and what is not. The AI system makes it possible to process enormous amounts of data from millions of previous operations and perform complex analyses. When fully developed, this system can function as a super-informed operating room assistant and bring about a revolution.’&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;PREDICTING MAINTENANCE&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Machine builders also visit AOMB to patent systems equipped with AI. A manufacturer of packing machines recently contacted us to improve the maintainability of its equipment using artificial intelligence. ‘There’s a global shortage of maintenance engineers, so you want to deploy them as targeted as possible. By analysing the data flows from sensors in the machines with AI, malfunctions can be identified at an early stage. For instance, from specific vibrations, AI can deduce that a certain axle is starting to show wear and needs to be replaced within two months. &lt;p&gt;Both examples concern AI that can probably easily be patented. Because it is new and inventive and not software as such, but part of a complete system, as Kneepkens explains. AI can also be of added value in his own field: ‘Having a human assess inventiveness is subjective. If you ask a hundred officials from the European Patent Office to give an opinion on the same invention, you will get a hundred different answers. AI can play a role in making that opinion more clear, so the outcomes for comparable cases are more predictable. That offers inventors a more level playing field.’&lt;/p&gt;
&lt;p&gt;He concludes with a personal outpouring: ‘AI fascinates me, more and more. In a few years, artificial intelligence will also have humour and sadness, all those things that make us human… It’s up to humans to set the right boundaries on AI in a timely manner.’ &lt;/p&gt;

&lt;p&gt;&lt;strong&gt;U.S. Patent No. 495,845&lt;/strong&gt;&lt;br /&gt; &lt;strong&gt;Issued April 18, 1893&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Another fascinating patent from 1893 is simply titled "Sleigh." While the title may lack creativity, it is certainly descriptive. Technologies from the early 1880s show that more comfortable sleigh rides were on the minds of many inventors. By the mid to late 1890s, improvements included additional features such as removable seats, steps to assist with entering and exiting the sleigh, and various steering mechanisms. What caught our attention was not the title, but the inventor's description of his prized invention:&lt;/p&gt;
&lt;p&gt;"My invention relates to improvements in sleighs... and the object of my invention is to improve the running gear of the side-bar spring sleighs, to the end that said running gear may be cheaply made, may be exceedingly strong, and will carry the body of the sleigh in a safe and correct manner."&lt;/p&gt;
&lt;p&gt;The mantra "cheaper, stronger, safer" is a timeless inventor's story. Inventors consistently strive to make things more durable, better, easier, faster, and of course, safer. Achieving these improvements economically is even more desirable. This patent, like others, demonstrates the common motivation of the creative mind, which remains unchanged from 1893 to today. The patent system fosters improvement, sometimes in leaps and bounds, but usually at a steady evolutionary pace.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;strong&gt;2.Lights for Christmas Tree&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;U.S. Patent No. 484,304&lt;/strong&gt;&lt;br /&gt; &lt;strong&gt;Patented October 11, 1892&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;In addition to being adorned with ornaments, Christmas trees have long been illuminated. Initially, candles were used, but with the advent of electricity, lights became the safer and preferred option.&lt;/p&gt;
&lt;p&gt;Lighting a tree with candles was perilous; the tree had to be fresh, and buckets of water were kept nearby to extinguish any fires. Typically, the candles were only lit once, on Christmas Eve, due to the risks involved.&lt;/p&gt;
&lt;p&gt;In 1882, following Thomas Edison’s development of the practical electric light bulb, Edward Johnson, his friend and partner in Edison’s Illumination Company, created the first set of "Christmas lights." This string of 80 red, white, and blue lights was wound around his Christmas tree. By 1895, the White House Christmas tree was adorned with hundreds of multi-colored incandescent lights.&lt;/p&gt;
&lt;p&gt;Incandescent lights illuminated Christmas trees throughout the 20th century. Although there were improvements, they functioned similarly to Edison’s original light bulb. Over time, various Christmas tree light inventions have emerged. As we look to the future, we can only imagine where Christmas tree lighting will go next.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;The festive season is, for many, a magical time of the year. When magic is in the air, our imaginations often work a little harder. For some inventors, however, imaginations are focused on solving problems that come but once a year.       <title>EPO vs UPC</title>
      <description>&lt;p&gt;&lt;span&gt;Has a European patent been granted to someone else and are you inconvenienced by this? With the advent of the Unified Patent Court (UPC), there is an additional option to have the patent declared invalid in multiple countries: a lawsuit at the UPC.&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;This additional option is in addition to an opposition procedure at the&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;a href="https://www.linkedin.com/company/european-patent-office/" target="_self" class="app-aware-link " data-test-app-aware-link=""&gt;&lt;span&gt;European Patent Office&lt;/span&gt;&lt;/a&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;(EPO) to revoke a patent in several countries at the same time.&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;The differences in these procedures can determine the choice of how to attack a patent. The main differences are:&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;Deadline ➤ An opposition to the EPO is possible up to 9 months after the grant of the patent. In the event of a lawsuit through the UPC, there is no end date.&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;Costs ➤ If you go to the EPO to oppose, this will cost 880 euros in agency costs. This is in stark contrast to the cost of a lawsuit at the UPC. For this, the costs to be paid to the court are 20,000 euros.&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;Territory ➤ A European patent can be valid in almost 40 countries, including outside the EU, so a successful opposition will completely annul the patent and in all countries where it is valid. If you attack a patent via the UPC, the outcome will only determine the EU countries that are members of UPC (maximum 18 countries). From a geographical point of view, the effect of an opposition via the EPO is therefore greater than the conduct of annulment proceedings via the UPC.&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;Turnaround time ➤ The EPO takes about two years to make a decision on a filed opposition. At the UPC, there seems to be a court ruling sooner so far, namely after about a year. This has everything to do with the fact that the deadlines for the EPA are longer, while the deadlines for the UPC are very tight.&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;It is precisely these tight deadlines that ensure that as a patent attorney I work with a team in UPC cases, while in the case of EPO oppositions it is not uncommon for these to be conducted by 1 patent attorney per party.&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;Proceedings before the EPO and UPC may be conducted on the same grounds for invalidity. One of the grounds for revocation of a European patent is unauthorised added matter.&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;Based on the first noises, the UPC seems to be less strict than the EPO. As a result, we can very cautiously say that the opposition procedure at the EPO seems more promising if an important ground for attack relates to unlawful added matter.&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span class="white-space-pre"&gt; &lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;In any invalidity procedure, it is important to carefully weigh all grounds and interests and to make a choice for one or the other procedure on that basis.&lt;/span&gt;&lt;/p&gt;

This decision marks a bold step towards improving the court’s operational efficiency, but it also raises concerns about maintaining the UPC's independence within the European patent system.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;A Timely Announcement&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The UPC’s announcement came as a surprise but was timely. Earlier this year, the court revealed its decision to replace the old CMS with a new system, projected to be implemented by mid-2025. This new CMS will be a joint venture with the EPO, a move that underscores the UPC’s responsiveness to user feedback and its commitment to enhancing its operational framework.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Addressing User Dissatisfaction&lt;/strong&gt;&lt;/p&gt;

The EPO and UPC are distinct entities within the European patent system, but their increasing cooperation—ranging from judge training to data exchange—raises questions about potential conflicts of interest.&lt;/p&gt;
&lt;p&gt;The UPC must establish a clear framework for this cooperation to safeguard its independence. As the UPC judges will be making decisions on the validity of patents granted by the EPO, maintaining a distinct and unbiased judiciary is paramount. Transparent and well-defined boundaries are necessary to prevent any doubts about the UPC’s impartiality.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Financial Considerations&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Another critical aspect of this development is the financial implications. The current CMS has been a significant financial burden, funded by taxpayers from 17 EU countries. The decision to replace it is not only a response to user dissatisfaction but also a strategic financial move. Continuing with the flawed system would have led to increased legal fees and made litigation prohibitively expensive, particularly for small and medium-sized enterprises (SMEs).&lt;/p&gt;
&lt;p&gt;By investing in a new CMS, the UPC aims to create a more cost-effective litigation environment, fulfilling its promise of affordable proceedings for all users, including SMEs. This financial prudence will help ensure that the UPC remains an accessible and viable venue for patent litigation.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Conclusion&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The UPC’s decision to develop a new CMS in collaboration with the EPO is a bold and necessary step towards improving its operational efficiency and user satisfaction.       <title>Hungary's Position and Representation Challenges at the UPC</title>
      <description>&lt;p&gt;As a Hungarian lawyer, recent developments in the Unified Patent Court (UPC) have highlighted the uncertainty surrounding representation for legal professionals from non-ratifying countries. In a notable case between Abbott and SiBio Biosciences, the UPC Court of Appeal suspended the enforcement of a preliminary injunction in Ireland due to the country’s failure to ratify the UPC Agreement.&lt;/p&gt;
&lt;p&gt;Ireland, alongside Hungary and several other EU states, has signed but not yet ratified the agreement, delaying full participation in the UPC system. For Hungarian lawyers, this raises concerns about our right to represent clients before the UPC. According to &lt;strong&gt;Article 48(1) of the UPC &lt;/strong&gt;Agreement, only lawyers authorized to practice in ratifying countries can represent clients before the court. Hungary's non-ratification means that legal professionals here remain in limbo, unable to fully engage with this significant new patent system.&lt;/p&gt;
&lt;p&gt;&lt;br /&gt; It's also important to note that the UPC Agreement, as an international legal instrument, holds a higher hierarchy in law. Therefore, &lt;strong&gt;Rule 286 of the Rules of Procedure of the UPC&lt;/strong&gt; cannot override the provisions of the UPC Agreement. In my view, this means that lawyers from non-contracting member states cannot rely on &lt;strong&gt;Article 1 of Directive 98/5/EC&lt;/strong&gt;, which allows for the free movement of lawyers within the EU. Without ratification, the right to represent clients at the UPC for lawyers from non-contracting states remains restricted.&lt;/p&gt;

      <title>Romania Becomes 18th EU State To Join Unified Patent System</title>
      <description>&lt;p&gt;NEWS FROM THE WORLD OF IP! &lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;The EU's Unitary Patent Agreement has been ratified by Romania as of May 31, 2024, making it the 18th state to join the Unitary Patent system. This means that unitary patents validated from September 1, 2024, will include territorial validity in Romania.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;For owners of newly granted European patents interested in extending their Unitary EU Patent coverage to Romania, there is an important administrative step. They may apply for postponement of the registration of the unitary effect after September 1, 2024. It’s crucial to note that the application for unitary effect must be submitted within one month from the date of publication of the notice on the granting of the European patent. This addition to the Unitary Patent system represents a significant expansion, providing patent holders with broader market protection and more streamlined enforcement across Europe. In a related development, the third central division of the Unified Patent Court, which replaces the originally planned division in London, will open in Milan on June 26, 2024. &lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;This new division will complement the existing central divisions in Paris and Munich, and cases will be allocated according to their technical field. The Milan division is expected to gradually handle cases falling under patent classification A, which includes pharmaceuticals and other human needs. These changes reflect ongoing efforts to create a more cohesive and efficient patent system within Europe, enhancing the ability of inventors and companies to protect their intellectual property effectively.       <title>EPO FEE INCREASES 1 APRIL 2024</title>
      <description>&lt;p&gt;In 2023, the European Patent Office (EPO) implemented wide-ranging fee increases on the procedural fees relating to patent filings, averaging around a 5% increase across the board.  Only a few fees remained constant.&lt;/p&gt;
&lt;p&gt;In 2024, the European Patent Office (EPO) has again announced a set of fee increases&lt;a name="_ftnref1" href="https://www.wynne-jones.com/news-events/2024/03/epo-fee-increases-1-april-2024/#_ftn1"&gt;&lt;span&gt;[1]&lt;/span&gt;&lt;/a&gt;&lt;span&gt; &lt;/span&gt;on procedural fees, to be effective from&lt;span&gt; &lt;/span&gt;&lt;strong&gt;1 April 2024&lt;/strong&gt;.  Whilst this may present unwelcome news for consumers, the fee increases this year are on average, slightly lower than last year, amounting to a 4% increase overall, and quite a few important frequently encountered fees are not increasing.  Notably, there appears to have been an&lt;span&gt; &lt;/span&gt;&lt;u&gt;effort to ring-fence upstream fees with the fees for filing an application&lt;/u&gt;, filing an opposition and filing an appeal remaining unchanged.  In contrast,&lt;span&gt; &lt;/span&gt;&lt;u&gt;downstream fees have increased a proportionally higher amount&lt;/u&gt;&lt;span&gt; &lt;/span&gt;– for example the third-year and fourth-year renewal fees typically payable whilst an application is still pending increasing by 30% and 28% respectively.  The EPO reports&lt;a name="_ftnref2" href="https://www.wynne-jones.com/news-events/2024/03/epo-fee-increases-1-april-2024/#_ftn2"&gt;&lt;span&gt;[2]&lt;/span&gt;&lt;/a&gt;&lt;span&gt; &lt;/span&gt;however, that in view of the changes, the usual biennial inflation adjustment applied on the fee charges will not apply in 2025 providing some certainty on fee levels for the short-term ahead.&lt;/p&gt;
&lt;p&gt;A new fee scheme for micro-entities is being introduced to increase accessibility for small applicants, with reduced fees at key milestones in the patent grant procedure, including for patent filing, search, designation of European states, examination, grant and renewal.  Only eligible micro-entities including natural persons, micro-enterprises and non-profit organisations can make use of this new scheme which provides a 30% reduction on all the main fees, whilst pre-existing discounts available for SMEs continue to be available.  To meet their eligibility criteria, there is a limit of five applications per year.&lt;/p&gt;

      <title>Ireland targets Unified Patent Court, confirming referendum date officially announced.</title>
      <description>&lt;p&gt;The Unified Patent Court (UPC) opened its doors on 1 June 2023 to hear matters relating to the validity and infringement of the new unitary patent and also European patents that have been made effective in various European states. At the time the doors opened only &lt;span&gt;&lt;a href="https://www.unified-patent-court.org/en/organisation/upc-member-states"&gt;17 EU states&lt;/a&gt;&lt;/span&gt; had ratified the Agreement to the UPC. A handful of other EU states have signed the Agreement, but to date, no further state has formally ratified.&lt;/p&gt;
&lt;p&gt;However, this may be about to change – on the 23 January 2024 the Irish government confirmed that Ireland will hold a referendum in June on whether to join the UPC. Ireland is required to pass a constitutional amendment in order to ratify its membership as the UPC is an international court and ratifying the Agreement will involve a transfer of jurisdiction to the UPC.&lt;/p&gt;
&lt;p&gt;Interestingly, if Ireland were to ratify the Agreement then it would become the only “common law” jurisdiction within the member states. The UK which also operates a “common law” system withdrew from the UPC in 2020 following the UK’s decision to leave the EU. An Irish local court division would therefore offer a different viewpoint on patent infringement matters and arguably add to the range of litigation forums for litigants. Moreover, since the Court of Appeal (based in Luxembourg) is to hear cases in the language of the Court of First Instance it is anticipated that the English-speaking, Irish local division may become quite a popular forum for UK and US based litigants for example.&lt;/p&gt;

      <title>Mickey Mouse, not quite free</title>
      <description>&lt;p&gt;&lt;span&gt;From 1 January 2024, the original version of Mickey from the famous 1928 cartoon "Steamboat Willie" is no longer protected by copyright.&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;Mickey should have fallen into the public domain in 1984. The term of copyright protection, which was 56 years at the time, was extended to 75 years (Copyright Act) and then to 95 years (Copyright Term Extension Act), under pressure from the Disney Corporation.&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;However, Mickey remains protected under trademark law. For example, the historic Steamboat character has appeared on the official Walt Disney Animation Studios logo since 2007 (USPTO Trademark No. 97285747).&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;In addition, later versions of the mouse, such as "Mickey Fantasia" and "Mickey, once upon a Christmas” remains copyrighted until 2036 and 2095 respectively.&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span&gt;Disney therefore still has the legal resources, particularly in the field of trademark law and even parasitism, to defend not only its famous mouse, but also the extended universe around it.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;This situation highlights the complexities and nuances of intellectual property law. This will definitely be one of the cases follow as it further develops. &lt;/span&gt;&lt;/p&gt;
